How do I Apply for Indigency?

The Indigency Program applies to individuals who are living at or below 125% of the federal poverty level, defined annually by the United States Department of Health and Human Services.


Application Required

Complete the Affidavit of Indigency accurately and in full, and submit it to the court so that a  hearing may be scheduled.

The information you give on this form must be current, complete, true and correct. By signing the attached “Unsworn Declaration” form, you declare under penalty of perjury that the information provided is true and correct. You can be prosecuted if you lie on this form.

Court Hearing Required

Upon receipt of the completed affidavit, the court will set a hearing in order for you to answer questions about your finances. A notice will be sent to the address that you provided in the affidavit and will include the date and time of the hearing. At the hearing the Judge will hear sworn testimony and look at your documentation to determine if you have sufficient resources to pay all or part of the fine and costs. If the Judge determines that you do not have the resources, you may have several options for taking care of the fine and costs:

  • the Judge may give you a time payment plan;
  • the Judge may allow you to perform community service;
  • the Judge may waive the fine and costs in full or part; or
  • the Judge may use any combination of the above methods.

Supporting Documentation Required

Supporting documentation is based on the financial affidavit and must be brought with you to your scheduled hearing (copies will remain in your case file). NO EXCEPTIONS. Failure to bring all documentation to your hearing SHALL result in your hearing being DENIED. You are expected to be prepared. Examples include: federal income tax return, statement of wages (pay stubs), all financial assistance (food stamps, WIC, Medicaid, etc.).
